Terms of Service

Last updated

The short version. Roomy is a Mac app that finds and removes files you choose. You can scan for free and clean up to 500 MB; Pro removes that limit. Monthly and Yearly plans renew automatically until you cancel, and a free trial turns into a paid subscription unless you cancel before it ends. Lifetime is a single payment. Your first purchase is covered by a 30-day money-back guarantee. Please keep backups of anything important.

This summary is here to help you find your way. It isn't a substitute for the full terms below, which are what legally apply.

1. About these terms

These Terms of Service (the "Terms") are an agreement between you and TSOFT LLC ("we", "us" or "our"), 9169 W State St #2547, Garden City, ID 83714, USA. They cover your use of the Roomy website, the Roomy app for macOS, your customer account, license keys and any purchase you make from us (together, the "Service").

By using the Service or making a purchase, you agree to these Terms. If you don't agree, please don't use the Service. Use of the app itself is also governed by our End User License Agreement ("EULA"). How we handle personal information is described in our Privacy Policy and Cookie Policy.

If you are using the Service on behalf of a company or other organization, you confirm that you are allowed to accept these Terms for it, and "you" includes that organization.

2. The Service

Roomy is software that scans your Mac for files you may not need, such as caches, logs, temporary files, developer build data, old downloads, duplicates and leftovers from apps, and removes the items you choose. All scanning and cleaning happens on your Mac. The website lets you download the app, buy a license, manage your billing and read our help center.

We may improve, change or stop offering parts of the Service over time. If we make a change that significantly reduces what you paid for during a paid period, we will tell you and, where appropriate, offer a fair remedy such as a pro-rata refund.

3. Eligibility

You must be at least 16 years old to use the Service. To make a purchase you must be old enough to enter into a binding contract where you live, or have the permission of a parent or guardian who agrees to these Terms on your behalf. You may not use the Service if you are barred from doing so under the laws that apply to you.

4. Your account

When you buy Roomy, we create an account tied to the email address you used at checkout. The first time, you sign in at https://roomymac.com/account/login with a one-time link that we email to that address, and then choose a password. You are responsible for keeping your password confidential. Because anyone who can read your email could use sign-in and password reset links, please keep your email account secure too.

You are responsible for activity in your account and for keeping your email address accurate. Tell us at [email protected] if you think someone else has accessed your account or license key.

5. Purchases, prices and payment

Our plans and their current prices are shown on our pricing page and at checkout. All prices are in US dollars (USD). If your card is issued in another currency, your bank may convert the amount and charge its own fees, which are outside our control. If any sales tax, VAT or similar tax applies to your purchase, it will be shown at checkout before you pay.

Payments are processed by Stripe, our payment processor. Your card details are entered directly with Stripe; we never see or store your full card number. By making a purchase, you authorize us, through Stripe, to charge your payment method for the amount shown at checkout and, for subscriptions, for each renewal as described in section 6.

Your purchase is complete when checkout succeeds and we show you your license key. We also email the key to you, and you can find it on your account page. We may refuse or cancel an order that appears fraudulent or that was placed at an obviously wrong price; if we do, we will refund any amount charged.

6. Subscriptions and automatic renewal

Monthly and Yearly plans are subscriptions that renew automatically. At the end of each billing period (one month or one year), your subscription renews for another period of the same length and we charge your payment method the then-current price for your plan, plus any applicable tax, until you cancel. The renewal date and price are shown at checkout, in your receipts, in the billing portal and in the app.

How to cancel. You can cancel at any time, with no cancellation fee:

  • on the website: sign in, open the Billing tab of your account page and choose Open billing portal, which opens the Stripe billing portal, then cancel your plan there; or
  • in the app: open Plans & Pricing (shown as Roomy Pro once you have Pro) or Settings → License, and click Manage Subscription…; or
  • by emailing [email protected] from the address you bought with.

To avoid being charged for the next period, cancel before your renewal date. When you cancel, renewals stop and Pro stays active until the end of the period you have already paid for. Deleting the app does not cancel a subscription.

No partial refunds. Apart from our money-back guarantee (section 9) or where the law requires otherwise, we don't give refunds or credits for partly used billing periods or for time you didn't use.

Price changes. We may change subscription prices. If we do, we will email you at least 30 days before the new price applies to your next renewal, so you have time to cancel if you don't want to continue. A price change never affects a period you have already paid for.

Failed payments. If a renewal payment fails, Stripe may retry it over the following days and we may ask you to update your payment method. If the payment still can't be collected, your subscription may be cancelled and the app will return to the free version.

7. Free trials

Monthly and Yearly plans may start with a free trial of 7 days, as shown at checkout. You enter a payment method when you start the trial, but you are not charged during it.

When the trial ends, it automatically becomes a paid subscription and we charge the plan price shown at checkout, then renew it as described in section 6, unless you cancel before the trial ends. If you cancel during the trial, you won't be charged. The date your trial ends is shown at checkout and in the billing portal.

Free trials are for new customers. We may limit trials to one per person, household or payment method, and we may decline or end a trial that is being misused.

8. Lifetime licenses

A Lifetime license is a single, one-time payment. It does not renew and you will not be charged again for it. It includes Pro for Roomy on up to 3 Macs and all future updates of Roomy that we release. "Lifetime" means the lifetime of the Roomy product, for as long as we continue to develop and offer it, not the lifetime of a person or a particular Mac. Separate new products we may release in the future are not included.

9. Refunds

First purchases of any plan, subscriptions and Lifetime, come with a 30-day money-back guarantee. To ask for a refund, email [email protected]. When a purchase is refunded, its license is deactivated on all Macs. The details, including timelines and exceptions, are in our Refund Policy, which forms part of these Terms. Nothing in these Terms limits any refund or cancellation rights you have under the consumer law of the country where you live.

10. Free version, license keys and devices

Free version. Without a license you can scan your Mac and clean up to 500 MB in total. A Pro license removes that limit while it is active.

License keys. Each purchase comes with a license key in the format ROOMY-XXXXX-XXXXX-XXXXX-XXXXX. Your key is for you. Don't share it, publish it or sell it.

Device limit. One license can be active on up to 3 Macs at a time. To move it to another Mac, deactivate one first, either in the app (Settings → License → Deactivate This Mac) or on your account page.

License checks. The app checks your license with our server when you activate it and about once a day while you use it. It keeps working offline for up to 21 days between checks. The Privacy Policy lists exactly what the app sends.

We may deactivate or revoke a license key that has been refunded or charged back, shared publicly, used on more Macs than allowed through circumvention, or obtained by fraud. Where it's practical and lawful, we'll contact you first.

11. Acceptable use

You agree not to:

  • copy, modify, reverse engineer, decompile or disassemble the app, except to the extent the law expressly allows it despite this restriction;
  • bypass, disable or interfere with license checks, the free cleaning allowance, device limits or any other technical limits;
  • share, publish, sell or generate license keys, or resell the Service without our written permission;
  • use the Service on a computer you don't own or aren't authorized to manage;
  • attack, overload, scrape or probe the website or license server, or try to access accounts or data that aren't yours;
  • use the Service to break any law or to infringe anyone's rights.

12. Your files and backups

Roomy removes files. It rates each item Safe, Review or Caution, selects only Safe, rebuildable items (such as caches and logs) for you, re-checks every path right before removal and moves anything that isn't rebuildable to the Trash. Even so, you decide what is removed, and you are responsible for reviewing items before you clean them, particularly items marked Review or Caution and anything you add to a clean yourself.

Caches, logs and similar data that apps rebuild are deleted straight away and cannot be restored from the Trash. Emptying the Trash is permanent. Please keep regular backups of your Mac; we recommend Time Machine, which is built into macOS. We can't recover files for you.

13. Intellectual property

The Service, including the app, its code, design, text, graphics and the Roomy name and logo, belongs to TSOFT LLC or its licensors and is protected by intellectual property laws. Apart from the rights granted in the EULA, no rights are transferred to you. If you send us feedback or ideas, we may use them without any obligation to you.

Apple, Mac, macOS, Finder, Safari, iCloud and Time Machine are trademarks of Apple Inc. Other product names belong to their owners. TSOFT LLC is not affiliated with or endorsed by Apple Inc.

14. Third-party services

We rely on third parties to provide parts of the Service, including Stripe for payments, subscriptions, receipts and the billing portal, and Google for website analytics and advertising measurement. When you pay through Stripe, Stripe's own terms and privacy policy also apply to that transaction. We are not responsible for third-party services we don't control, but we choose our providers carefully and describe how they handle your data in our Privacy Policy.

15. Disclaimers

We work hard to make Roomy reliable and safe, but software can have bugs, and every Mac is different. To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted or error-free, or that it will free a particular amount of disk space or make your Mac faster.

Some countries don't allow certain warranties to be excluded. If you are a consumer, you keep any rights that cannot lawfully be excluded, and this section applies only as far as the law allows.

16. Limitation of liability

To the fullest extent permitted by law, TSOFT LLC and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits, revenue, business or goodwill, arising out of or related to the Service, even if we were told such damages were possible.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid us for Roomy in the 12 months before the event that gave rise to the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold TSOFT LLC harmless from claims, losses and reasonable costs (including legal fees) brought by third parties that arise from your breach of these Terms or the EULA, or from your misuse of the Service. This section does not apply to consumers where local law doesn't allow it.

18. Suspension and termination

You can stop using the Service at any time. Cancel any subscription as described in section 6 and, if you like, follow our guide to uninstall Roomy.

We may suspend or end your access to the Service, including deactivating your license, if you materially breach these Terms or the EULA, if your payment is charged back or found to be fraudulent, or if we must do so by law. Where reasonable, we will tell you why and give you a chance to fix the problem first. If we end the Service for reasons that are not your fault, we will refund any unused part of a prepaid subscription.

Sections that by their nature should continue after termination, including sections 12 to 17, 19 and 21, survive it.

19. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules. If you are a consumer, you also keep the protection of any mandatory provisions of the law of the country where you live, and you may bring a claim in the courts of that country if its law allows it.

If you have a problem, please email us first at [email protected]. Most issues can be sorted out quickly, and we will try in good faith to resolve any dispute informally within 30 days before either of us starts formal proceedings.

20. Changes to these terms

We may update these Terms from time to time, for example when we add features or when the law changes. The date at the top of this page shows when they last changed. If a change materially affects your rights, we will tell you by email or in the app before it takes effect. Changes don't apply retroactively, and changes to subscription prices follow section 6. If you don't agree with an update, you can stop using the Service and cancel your subscription before the change takes effect.

21. General

  • Entire agreement. These Terms, together with the EULA, Refund Policy, Privacy Policy and Cookie Policy, are the whole agreement between you and us about the Service.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. If we don't enforce a right straight away, we haven't given it up.
  • Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets, provided your rights under these Terms are not reduced.
  • Events beyond our control. We aren't responsible for delays or failures caused by events outside our reasonable control.
  • Language. These Terms are written in English. If we provide a translation, the English version applies where they differ, unless local law says otherwise.
