End User License Agreement

Last updated

This End User License Agreement (the "EULA") is a legal agreement between you and TSOFT LLC ("we", "us" or "our") for the Roomy app for macOS, including its updates and documentation (the "Software"). By installing, opening or using the Software, you agree to this EULA. If you don't agree, don't install or use the Software.

Your purchases, subscriptions and use of our website are covered by our Terms of Service, which apply together with this EULA. If the two conflict on a point about the Software itself, this EULA applies.

1. License grant

The Software is licensed, not sold. Subject to this EULA, we grant you a personal, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on Macs that you own or control:

  • Free version. You may use the Software without a license key to scan your Mac and to clean up to 500 MB in total.
  • Pro. With a valid, active license key, you may use all Pro features, without the cleaning limit, on up to 3 Macs at a time. For a subscription, the Pro license lasts while your subscription is active or in its trial, plus any short grace period we allow. For a Lifetime license, it lasts for the lifetime of the Roomy product, as described in our Terms of Service.

Your license key is for your own use. If an organization buys a license, it may assign it to one person at a time to use on up to 3 Macs.

2. Restrictions

Except as this EULA allows, or as the law expressly allows despite this restriction, you may not:

  • copy, modify, translate or create derivative works of the Software;
  • reverse engineer, decompile or disassemble the Software, or try to derive its source code;
  • distribute, publish, sell, rent, lease, lend, host or sublicense the Software, or offer it as a service to others, including by bundling it with other software;
  • share, publish, sell or transfer your license key, or use one key on more Macs than allowed;
  • circumvent, disable or tamper with license activation, license checks, signed license tokens, the free cleaning allowance, device limits or any other technical protection, or use or create key generators, cracks or patches;
  • remove or alter any copyright, trademark or other notices in the Software;
  • use the Software on a computer you don't own or aren't authorized to manage, or in breach of any law.

3. Activation and license checks

To turn on Pro, the Software activates your license key with our license server, which returns a digitally signed license token. The Software then re-checks your license about once a day while you use it. It works offline for up to 21 days between checks; after that, Pro pauses until the Software can reach our server again. If your subscription ends, or your purchase is refunded or charged back, the Software returns to the free version at its next check.

You can move your license to another Mac by deactivating one first, in the Software under Settings → License → Deactivate This Mac or on your account page.

4. What the Software does with your files

The Software finds files you may not need and removes the ones you choose. It rates each item Safe, Review or Caution and selects only Safe, rebuildable items for you. Caches, logs and other data that apps rebuild are deleted right away; other items are moved to the Trash. You can exclude any file or folder. You are responsible for reviewing what you remove and for keeping backups of your data; we recommend Time Machine. Items that are deleted, or that are removed from the Trash when you empty it, can't be recovered by us.

Some items, such as apps installed for all users, can only be moved with an administrator password. macOS asks you for it directly; the Software never sees or stores it.

5. Updates

We may release updates that fix bugs, improve safety checks, add or change features, or keep the Software compatible with new versions of macOS and with our license server. Updates are included with active subscriptions and with Lifetime licenses, and are available from our download page. Each update is covered by this EULA unless it comes with different terms. We may stop supporting older versions of the Software or of macOS; the current minimum is macOS 14 Sonoma or later.

6. Data and privacy

All scanning and cleaning happens on your Mac. When it activates or checks your license, the Software sends only your license key, a device ID that is a one-way hash of your Mac's hardware UUID, your Mac's name and the app version. It never sends file names, file contents, scan results, browsing data, analytics or telemetry. Our Privacy Policy has the details.

7. Ownership

The Software, including its code, design and documentation, and the Roomy name and logo, are owned by TSOFT LLC or its licensors and are protected by copyright, trademark and other laws. All rights not expressly granted to you in this EULA are reserved. If the Software includes open-source components, those components are licensed under their own terms, which take precedence for those components.

8. Term and termination

This EULA applies from when you first install or use the Software until it ends. You can end it at any time by deleting the Software from your Macs; our guide to uninstalling Roomy explains how. It ends automatically, without notice, if you materially breach it, for example by sharing your key or circumventing license checks. When it ends, you must stop using the Software and delete all copies. Ending a Pro license alone, for example when a subscription ends, returns the Software to the free version rather than ending this EULA. Sections 2, 7 and 9 to 13 survive termination.

9. Warranty disclaimer

To the fullest extent permitted by law, the Software is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that the Software will be error-free or uninterrupted, that it will free a particular amount of space or improve performance, or that it will meet your requirements. If you are a consumer, you keep any rights that cannot lawfully be excluded, and this section applies only as far as the law allows.

10. Limitation of liability

To the fullest extent permitted by law, TSOFT LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits, revenue or business, arising out of or related to the Software or this EULA, however caused, even if we were told such damages were possible. Our total liability under this EULA is limited to the amount you paid us for the Software in the 12 months before the event that gave rise to the claim. Nothing in this EULA limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

11. Export and sanctions

You may not download, use, export or re-export the Software in breach of export control or sanctions laws that apply to you or to us, including those of the United States. By using the Software, you confirm that you are not located in a country, and are not a person, that those laws prohibit from receiving it.

12. Apple

Roomy is distributed directly by TSOFT LLC from our website, not through the Mac App Store. This EULA is between you and us only. Apple Inc. is not a party to it, has no obligation to provide support or maintenance for the Software, and is not responsible for the Software or any claims relating to it. Apple, Mac, macOS, Finder, Safari, iCloud and Time Machine are trademarks of Apple Inc., registered in the U.S. and other countries. TSOFT LLC is not affiliated with or endorsed by Apple Inc.

13. Governing law and general terms

This EULA is governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules. If you are a consumer, you also keep the protection of mandatory consumer laws of the country where you live. If any part of this EULA is found unenforceable, the rest stays in effect. If we don't enforce a right straight away, we haven't given it up. You may not transfer this EULA or your license without our written consent. We may update this EULA for future versions of the Software; the date at the top of this page shows when it last changed, and we will tell you about material changes before they apply to you.
